A German court has stopped the art world from becoming even more chaotic.
Birkenstock sandals are not art, says German court
The company had claimed its footwear could be classified as art and so was protected by copyright laws in a case it put forward to stop rivals selling copycat versions of the cork-soled sandals.
But a judge dismissed the claim, saying the shoes were practical design items - a decision Birkenstock called a "missed opportunity for the protection of intellectual property".

We live in a world where Duchamp’s Fountain is an art object, where naked people at the entrance are part of a performance, and where a banana taped to a wall and beer cans on the floor are also regarded as art.
Why can’t sandals be art? Maybe because, unlike art, they sell without any trouble (lol) 🙂
The German court refused to open Pandora’s box, stopping big commercial brands from using art as a cover for their business interests that have nothing to do with creativity.
